29 CFR 1926.1101(d)(2): Asbestos hazards at a multi-employer work site were not abated by the contractor who created or controlled the source of asbestos contamination:    a.)    Amark Environmental LLC., 2 East 3rd Avenue, Warren, PA 16365, on or about August 21, 2013 and times prior thereto:  Company employees were performing asbestos abatement measures to the Warren Beaty Middle School.  Asbestos hazards at the work site were not abated completely in that, analysis of bulk samples taken from various areas at the construction site, after abatement had been completed, revealed that Chrysotile asbestos containing material were still present in, but not limited to, the following areas:  Southwest corner of the school (soffit/Transite removal area), floor tile area next to the gymnasium hallway (1st floor), soffit area on the rooftop of the school.

29 CFR 1926.1101(l)(4)(ii): Waste and debris and accompanying dust in an area containing accessible thermal system, surfacing ACM/PACM, or visibly deteriorated ACM was not promptly cleaned up and disposed of in leak tight containers:    a.)    Amark Environmental LLC., 2 East 3rd Avenue, Warren, PA 16365, on or about August 21, 2013 and times prior thereto:  Company employees were performing asbestos abatement measures to the Warren Beaty Middle School.  Analysis of bulk samples taken from various areas including but not limited to, the Southwest corner of the school (Soffit-Transite removal area), floor tile area next to the gymnasium hallway (1st floor), and soffit area on the rooftop of the school, indicated that Chrysotile asbestos was present after asbestos abatement.
