29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:    (a)Western TelCom Inc., at West Side of 6850 E. U.S. Hwy 34, Loveland, CO 80537: On September 21, 2013 the  employer did not ensure the employee working from the Genie S-85, articulating boom aerial lift, was protected from falling from the basket by a body harness with a lanyard attached to an anchorage point in the basket.  This condition exposed the employee to a fall hazard or the hazard of being ejected from the basket.      Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:    (a)Western TelCom Inc., at West Side of 6850 E. U.S. Hwy 34, Loveland, CO 80537:  On September 21, 2013, the employer did not have each employee who performs work while on an aerial lift trained by a person qualified in the subject matter to recognize those hazards associated with the type of aerial lift(s) being used and to understand the procedure(s) to control or minimize those hazards.  This condition exposed the employees to a fall hazards due to not recognizing the hazards associated with working on the aerial lift.      Abatement Note: The training shall include the following elements at a minimum:    (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;    (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:    (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;    (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and    (5)  Any other pertinent requirements of this subpart.
