This contractor is the General Contractor/Building Owner, controlling and correcting employer at the site. The superintendent/Building owner stated he conducts daily inspections and is continuously monitoring all operations. The superintendent/Building owner stated in his interview that he corrected observed hazards involving the sub-contractor prior to the inspection. Therefore, he was aware of the operations in progress. This contractor is being cited Under the Multi-Employer Workplace Policy.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) East Side of the Building 2nd Floor - A group leader and carpenters were observed without fall protection leaning out the window exposing them to a 17 foot fall hazard, on or about 08/20/13.   b) 2nd Floor Loft Stairway Opening - Roofers were observed working around an unguarded opening exposing them to a 10 foot fall hazard, on or about 08/20/13.    c) 1st Floor Stairway Opening - Carpenters were observed working around an unguarded stairway opening exposing them to a 12 foot fall hazard, on or about 08/20/13.   d) Roof of the Building - Roofers were observed without fall protection removing materials from the roof exposing them to a 25 foot fall hazard, on or about 08/20/13.   This contractor is the General Contractor/Building Owner, controlling and correcting employer at the site.
