29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:   A. Exterior Solutions, LLC worksite located at 2519 N. Holland Sylvania, Toledo, Ohio: On or about August 19, 2013, the employer did not ensure employees wore proper eye protection while operating pneumatic nail guns to secure weatherproofing on the single story structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:     A. Exterior Solutions, LLC worksite located at 2519 N. Holland Sylvania, Toledo, Ohio: On or about August 19, 2013, the employer did not ensure employees were protected from falls while installing weatherproofing on the single story residential type structure.  The employees were exposed to a potential fall distance of approximately 9.00 feet from the 4/12 pitch roof.
