29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: An employee performing gutter installation at the rear of the building being erected utilized a tie-off point positioned on the roof in such a manner that he would be exposed to the hazard of striking the roof approximately twelve feet below the working surface on the scaffold.

An employee performing gutter installation at the rear of the building being erected utilized the mid-rail of the guardrail system on the scaffold as a tie-off point. The employee was exposed to a fall hazard in excess of ten feet to the roof below as well as the hazard of scaffold collapse.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Employees performing gutter installation from a tubular welded scaffold had not been adequately trained to recognize and abate the hazards associated with working from a scaffold. Employees were exposed to a fall hazard of up to approximately twelve feet.
