29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)      On or about 08/29/13,  in the Housing Development under construction (Building 1C), located at 151 Sunset Center Lane in Clarkson, New York, employees were installing roof sheathing 16 feet above ground level without the use of fall protection.  The employer could not demonstrate that the use of conventional fall protection methods were infeasible or created a greater hazard.  NO ABATEMENT CERTIFICATION REQURIED

29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection.   (a)      On or about 08/29/13,  in the Housing Development (building 1C), under construction, located at 151 Sunset Center Lane in Clarkson, New York, employees were not provided a guardrail system with a top rail measuring between 39 to 45 inches in height from the floor level.   NO ABATEMENT CERTIIFICCATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   (a)      On or about 08/29/13,  in the Housing Development, (Building 1C) under construction, located at 151 Sunset Center Lane in Clarkson, New York,  an A-Frame ladder which did not extend at least 3 feet above the landing surface, was used to gain access to the second floor.  NO ABATEMENT CERTIFICATION REQUIRED
