29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person: a) On or about September 3, 2013, and at times prior, stucco employees working at 6564 Little River Way were exposed to falls while they worked on fabricated frame scaffold which had not been constructed per the design nor by a qualified person. Several platforms were constructed of planks that rested on 2x4s that were tied to the frame with wire. These planks should have rested on the bearer section of the frame as it was designed.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii): a) On or about September 3, 2013, and at times prior, stucco employees working at 6564 Little River Way were exposed to falls while they worked on fabricated frame scaffold which had not been fully planked. Scaffold levels at 13 feet and above were equipped with only two of the three planks for which they were designed. b) On or about August 31, 2013, and at times prior, stucco employees working at 25603 E. Calhoun Place were exposed to falls while they worked on fabricated frame scaffold which had not been fully planked. 29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. a) On or about September 3, 2013, and at times prior, stucco employees were exposed to falls while they worked on fabricated frame scaffold which had numerous hazards including inadequate platforms and a lack of fall protection. The employees erected and worked on the scaffold without receiving training from a competent person that would enable them to recognize and correct the hazards.
