29 CFR 1926.304(d): All portable, power-driven circular saws were not equipped with guards above and below the base plate or shoe.   When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position:  This violation was most recently observed on or about August 27, 2013, at the worksite located at 720 Country Side Drive, Prosper, Texas 75078; where employees were exposed to struck-by hazards while using a Makita circular saw with the lower guard in the opened position.
