29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: The employer does not ensure that employees are protected from falling while working around holes more than six feet above lower levels. This violation occurred on or about September 03, 2013, when employees were exposed to fall hazards while on top of a concrete water tank that had four access holes without any means of fall protection systems. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees engaged in construction activities are protected from falling distances greater than six feet.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c): The employer does not ensure that employees are protected from cave-ins while working in excavations. This violation occurred on or about October 29, 2013, at the construction site where employees were exposed to cave-in hazards while working in an excavation without an adequate protective system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all excavations that employees are required to work in are either sloped, benched, or shored on all sides of the of the excavation in accordance with 29 CFR 1926.652 paragraph (b) and/or (c) to prevent possible cave-ins.

This violation occurred on or about October 29, 2013, and at times thereafter, at the construction site where employees were exposed to an impalement hazard while walking and working around protruding reinforcing steel at the bottom of an excavation without guarding to eliminate the impalement hazard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all protruding reinforcing steel is guarded to eliminate the hazard of impalement.
