Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from struck-by, caught between, crushed-by hazards which are causing or likely to cause death or serious physical harm to employees:      A.    The violation occurred in Automotive Repairs Bays on or about September 3, 2013 and at times prior thereto where the employer failed to ensure operation of the automotive lifts was in accordance with safe operating practices such as:   a.     #2 and #3 Rotary Lifts positive or continuous stops (locking devices) did not always fully engage   b.     #2 Rotary Lift swing arms restraints that were not properly working and/or were missing or broken       B.    The violation occurred in Automotive Repairs Bays (1-5 East to West) on or about September 3, 2013 and at times prior thereto where the employer failed to ensure employees were trained and that training was documented for:  a.     Use and operation of the Automotive Lifts  b.     Inspection of the lifts      C.    The violation occurred in Automotive Repairs Bays (1-5 East to West) on or about September 3, 2013 and at times prior thereto where the employer failed to ensure periodic inspections of the lifts were completed and any observations, findings, and repairs documented for the Rotary Lifts.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are not exposed to Struck-by, Caught Between, and Crushed-by hazards.
