OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  (a) Jersey Rail Location, Frontage Road: On or about September 11, 2013 and at times prior, employees were exposed to a struck by and crushing hazard while moving concrete forms with a Gradall Model 534D10-45 Telehandler using unrated under the hook lifting devices.  (b) Jersey Rail Location, Frontage Road: On or about September 11, 2013 and times prior, employees were exposed to a struck by hazard while moving concrete forms with a Gradall Model 534D10-45 Telehandler with damaged safety latches where the unrated under the hook lifting devices attaches to the form.
