OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard due to improper ladder use. This violation was observed on September 12, 2013; where employees were accessing an upper working surface with a metal telescoping extension ladder that was not extend beyond the upper level, nor was a grasping device available for employees stepping to and from the ladder.

29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed. This violation was discovered on September 12, 2013 where employees were using a seat harness with defective shock absorber on the lanyard system while cleaning windows on the 5th floor of the PJKK Federal building. The shock absorption portion of the lanyard was taped together instead of being replaced with a design that is in accordance with the manufacturers recommendations for shock absorption.
