29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a.  On or about September 16, 2013, at the above addressed jobsite, an employee using a pneumatic nail gun did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a.  On or about September  16, 2013, at the above addressed jobsite, an employee performing residential roofing operations on a steep roof (5:12 or more), nineteen (19) feet six (6) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.
