29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   The employer does not protect employees from falling from unprotected sides or edges which are 6 feet or more above a lower level.  This violation was observed on or about September 18, 2013, at the jobsite, where employees were exposed to a fall hazard of more than 6 feet when walking along the second floor walkway that had no fall protection system in place.             Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a guardrail system, safety net system or personal fall arrest system is installed on the second floor walkway.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  The employer does not ensure that a stairrail system is provided along each unprotected side or edge of a stairway.   a.    This violation was observed on or about September 18, 2013, in the Lobby where employees were exposed to a fall hazard when accessing the inside spiral staircase leading to the second floor.              b .      This violation was observed on or about September 18, 2013, in the Courtyard where employees were exposed to a fall hazard when accessing the outside stairs leading to the second floor walkway.          Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a stairrail system is provided for all stairs having four or more risers or rising more than 30 inches.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926:   The employer does not protect employees from falls from unprotected sides or edges of stairway landings.     a.    This violation was observed on or about September 18, 2013, in the Lobby where employees were exposed to a fall hazard when walking and working around the inside spiral staircase landing that did not have a guardrail.              b .      This violation was observed on or about September 18, 2013, in the Courtyard where employees were exposed to a fall hazard when walking and working around the outside stair landing that did not have a guardrail.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a guardrail system is provided for all unprotected sides and edges of stairway landings.
