OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about September 19, 2013, and at times prior, Alpine Auto Body Inc. employees were exposed to struck-by hazards in that: a) Auto lifts were not periodically inspected by qualified inspectors at least annually to ensure that they were properly maintained and functioning. b) The employer had not trained employees on the safe use and operation of the lifts using the manufacturer's provided instructions. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel: a) On or about September 19, 2013, and at times prior, Alpine Auto Body Inc. did not ensure that abrasive wheel guards were constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel. In the automotive repair bay, a bench grinder was observed without the required tongue guard. A makeshift plexiglass cover was welded to the upper area of the grinder as a substitute for a proper tongue guard. Spray bottles contained chemical cleaners and degreasers. Work space shared by at least two employees. b) A 1-gallon metal container without labels or tags was observed in one of the cabinets in the painting area. It contained thinner. Work space is shared by at least two employees. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
