29 CFR 1910.1200(e)(2)(ii): The employer's hazard communication program did not include methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operations and in foreseeable emergencies: (Construction Reference: 1926.59) For operations involving production of silica dust at 4001 South Lamar in Austin, Texas: On or about July 19, 2013 and at times prior thereto, the employer did not implement an effective hazard communication program in that it failed to inform other contractors at the worksite regarding the hazards of silica dust and precautionary measures to be taken to protect themselves from silica dust generated while cutting penetrations in concrete masonry unit (CMU) block and knocking out cutouts.
