29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:      On or about September 26, 2013, located on the upper roof area of an existing commercial structure, a HVAC worker was engaged in commercial repair/service activities. Worker was exposed to a potential 16.3 foot fall hazards in that a standard railing was not provided.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: Located on the upper roof area of an existing commercial/retail structure, a Heating, Ventilation, and Air Conditioning  (HVAC) technician was engaged in repair activities servicing a HVAC unit exposed to potential fall hazards in excess of 4.0 feet.            On or about September 26, 2013, located on the upper roof area of an existing commercial structure, a HVAC worker was engaged in commercial repair/service activities. Worker was exposed to a potential 16.3 foot fall hazards in that a proper fall protection system was not provided.
