OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard:  a) 2500 Grubb Road, Wilmington, DE  19810 (Brandywood Plaza, Southwest Parking Lot) - Employees were exposed to struck-by and crushed-by hazards while handling unsecured server/storage racks.  An employee was fatally injured after being struck by and crushed by an approximatley 1,270 pound server/storage rack that was not secured from falling from the liftgate of the truck, on or about September 30, 2013.  ABATEMENT NOTE:  Feasible methods of abatement, among others, include:    1. Follow the safety information described in the Waltco Lifgate Owner's Manual, and the Hitachi Unified Storage VM Block Module Hardware User Guide; and, follow the safety precautions purveyed by the International Safe Transit Association (ISTA) Rack Transit Stability Team (RTST).  2.  Provide liftgates with cart-stops, a part described in the Waltco Liftgate Owners Manual (or a retention ramp) to prevent materials, such as, but not limited to those equipped with wheels, from sliding-off the platform during lifting  3. Follow preventive maintenance requirements described in the Waltco Liftgate Owners Manual such as, but not limited to, those describing a check for and an adjustment to platform tilt.  4. Implement an employee training program to educate employees on appropriate safe material handling techniques, with emphasis on pertinent safety guidance imparted by the Waltco Liftgate Owners Manual, the Hitachi Unified Storage VM Block Module Hardware User Guide, and the International Safe Transit Association (ISTA) Rack Transit Stability Team (RTST).
