Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees at Pier 12, the Main Terminal Tank Farm and piping systems of Defense Fuel Support Point (DFSP) in San Pedro, California where the employees were exposed to potential fire and explosion from the release of flammable liquids in that:    a)      Appropriate tools were not utilized, such as but not limited to, intrinsically safe flashlights and communications equipment where required in controlled areas.     b)      Flammable and combustible storage tanks were located less than 200 feet from the control room and adjacent industry, and were located within close proximity to an active weapons firing range.     c)      The Main Terminal control room was located less than 200 feet from a loading rack.     d)      A portable flammable storage unit was used as a testing laboratory without a hazard identification analysis and design modifications for safe human occupancy.     e)      Piping and instrumentation diagrams (P&ID) were not updated after changes and modifications to the system, such as but not limited to, the replacement of ball valves with double block and bleed valves.      f)       Management of Change (MOC) procedures were not utilized for additions, modifications or procedural changes that occurred at the facility, such as but not limited to, modification of control room monitors and valves in the piping system.     g)      Continued monitoring of the control room during loading, pump shutdowns and fuel transfers to control potential unexpected occurrences, leaks, or other emergencies was not maintained.     h)      Emergency stop buttons were not located for effective emergency response.      i)       Effective and continuous means of communication for safe operations was not available.     j)      No written safety procedures for critical operations, such as but not limited to, conducting Quality Assurance and Quality Control testing at the truck rack, Lab and at Building 103, operating the Pier 12 Loading Arms, or to address tasks that required the operator to leave the control room.

29 CFR 1910.132(a): Protective equipment was not provided when necessary whenever hazards capable of causing injury and impairment were encountered:    Main Terminal, Truck Rack:  On September 26, 2013  and at times prior thereto, personal fall protection equipment was not provided for employees working on top of tank trucks at a height of at least 8 feet where guard rails were ineffective.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:     Pier Terminal, Pumphouse, Pumps 2 and 3:  On November 15, 2013 and at times prior thereto, machine guarding was damaged so that employees were exposed to rotating parts.
