Construction Reference: 1926.59 NOTE: The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter.  29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:  a) On or about 09 October 2013, the employer did not provide the employee(s) with training regarding the measures employee(s) can take to protect themselves against the health hazards of workplace chemicals.   Employee(s) were exposed to hazardous matter (pH 12-13) containing up to 40% crystalline silica when spreading fresh PakMix Type S Masonry Mortar using a shovel, without wearing hand protective equipment (i.e. gloves), inside a vault for water service pipes.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  a) On or about 09 October 2013, the employer did not ensure that employee(s) spreading fresh PakMix Type S Masonry Mortar (containing up to 40% Crystalline Silica) using a shovel, inside a vault for water service pipes,  used eye protection (safety glasses) to protect them against fresh mortar splashes.
