Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazardous atmosphere:   (a) On or about October 9, 2013, for the employee engaged in roustabout activities where the removal and replacement of recycling pipe resulted in death from exposure to hydrogen sulfide gas at the OXY USA, Inc. oil well site, SESE Section 20-T144-R97, (Kukla A-1), Manning, ND.   Abatement Note: Among other methods, feasible and acceptable abatement methods to correct the hazard would be for the employer to develop and implement comprehensive safe work practices, safe work permits and provide hydrogen sulfide safety training in accordance with American Petroleum Institute (API) Recommended Practice 55, Second Edition for Oil and Gas Producing and Gas Processing Plant Operations Involving Hydrogen Sulfide, specifically Section 5.1 PERSONNEL TRAINING: "Personnel assigned to work in areas where they may be exposed to hydrogen sulfide or sulfur dioxide shall be trained by a hydrogen sulfide safety instructor, as defined in Par. 5.6."; Section 9.4 SAFE WORK PRACTICES: "Safe operating procedures should be developed for performing operations and maintenance (e.g., tank gauging, water line blowdown, line repair, valve replacement, and sampling) so hazards due to the release of hydrogen sulfide can be avoided."; and Section 9.6 SAFE WORK PERMITS: "For activities without previously established operating procedures, special safety review documentation (e.g., hot work permits and check-off lists) outlining specific safety precautions with specific authorization should be used. Documentation should include personnel protective equipment required; equipment that should be properly blinded, blanked, or disconnected; equipment and piping that should be properly vented; procedures for excavation of buried lines in processing areas; etc."

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to, items of this section:                                                                 OR IN THE ALTERNATIVE   Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the uncontrolled release of energy:     (a) On or about October 9, 2013, for the employee engaged in roustabout activities where the removal and replacement of recycling pipe resulted in death from the uncontrolled release of hazardous energy and exposure to hydrogen sulfide gas at the OXY USA, Inc. oil well site, SESE Section 20-T144-R97, (Kukla A-1), Manning, ND.  Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be for the employer to ensure personnel perform lockout/tagout procedures on the removal and replacement of oil recycling pipe to control the release of energy in accordance with American Petroleum Institute (API) Recommended Practice 54, Third Edition, Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, Section 6.9 LOCKOUT/TAGOUT, subsection 6.9.1a: "Locks and/or tags should be placed to plainly identify the equipment or circuits being worked on. Critical systems locked or tagged should include the identity or job title of person installing the lock or tag."
