OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by injuries:  a) Farm and surrounding fields: On October 21, 2013 and at times prior thereto, employees operated Honda TRX250TM and  Honda TRX420TM four wheeled all-terrain vehicles (ATV) without protective helmets.  Employees operated the ATVs on a daily basis to travel around the fields and move irrigation hand lines.    b) Farm and surrounding fields: On October 21, 2013 and at times prior thereto, employees were permitted to operate the Honda TRX250TM and the Honda TRX420TM four wheeled all-terrain vehicles (ATV) in an unsafe manner, including but not limited to, at high rates of speed on uneven ground.  Employees operated the ATV's on a daily basis to travel around the fields and move irrigation hand lines.    Note) Abatement documentation AND certification are required for this item.
