OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) In the warehouse: On October 23, 2013 and at times prior to; the employer failed to provide a railing system for the man basket that is used for lifting employees to upper levels of the steel rack, exposing those employees to falls of up to 14 feet. (b) In the warehouse: On October 23, 2013 and at times prior to; the employer failed to secure the man basket to the forks of the forklift exposing employees to falls of up to 14 feet.
