29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.:     (a). Worksite located at 8380 N. Booth, Kansas City, Missouri- Employees were exposed to hazards from working with chemicals such as, but not limited to, vinyl sealer and were not provided personal protective equipment such as respirators, eye protection and protective gloves.

29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not  provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas are being used on the jobsite. This requirement does not apply to the integral fuel tanks of motor vehicles:     (a). Worksite located at 8380 N. Booth, Kansas City, Missouri- Employees were exposed to fire hazards while working with numerous gallons of vinyl sealer and stain,  both of which are highly flammable and being sprayed on the wood forming a mist without the use of any extinguishment equipment in proximity.

29 CFR 1926.404(b)(1)(i): General. The employer did not  use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors:     (a). Worksite located at 8380 N.  Booth, Kanas City, Missouri- Employees were exposed to a shock or electrocution hazard in that the employees had plugged an extension cord in to an outlet that was not provided a groundfault circuit interrupter.

29 CFR 1926.404(f)(5)(i): Grounded system. For a grounded system, a grounding electrode conductor  was not used to connect both the equipment grounding conductor and the grounded circuit conductor to the grounding electrode. Both the equipment grounding conductor and the grounding electrode conductor shall be connected to the grounded circuit conductor on the supply side of the service disconnecting means, or on the supply side of the system disconnecting means or overcurrent devices if the system is separately derived:     (a). Worksite located at 8380 N.  Booth, Kansas City, Missouri- Employees were exposed to a shock or electrocution hazard in that the employees had used a two-prong extension cord to power a tool, electric sprayer, which required a grounding receptacle. The employees then plugged the cord in to a non-GFCI protected outlet which also had reversed polarity.

29 CFR 1926.405(a)(2)(ii)(J): Extension cord sets used with portable electric tools and appliances not three-wire type and were not designed for hard or extra-hard usage.    NOTE: The National Electrical Code, ANSI/NFPA 70, in Article 400, Table 400-4, lists various types of flexible cords, some of which are noted as being designed for hard or extra-hard usage. Examples of these types of flexible cords include hard service cord (types S, ST, SO, STO) and junior hard service cord (types SJ, SJO, SJT, SJTO).     (a). Worksite located at 8030 N. Booth, Kansas City, Missouri- Employees were exposed to a shock, fire or electrocution hazard in that the employees were observed using a two-prong, low-voltage rated extension cord that was plugged in to a non-GFCI protected outlet which also had reversed polarity.
