29 CFR 1910.157(c)(1): Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries: a) On October 23, 2013, and times prior thereto, the employer failed to ensure that an above-ground LPG storage tank was provided with a portable fire extinguisher which was mounted and readily accessible so not to contribute to employee injury. b) On October 23, 2013, and times prior thereto, the employer failed to ensure that an above-ground diesel storage tank #220 was provided with a portable fire extinguisher which was mounted and readily accessible so not to contribute to employee injury. ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) On October 23, 2013, and times prior thereto, the employer failed to develop and maintain a written hazard communication program that included chemicals not limited to propane to which employees were exposed, labels and safety data sheets to protect and warn them of related hazards in the workplace, and employee training requirements of the standard, exposing employees to skin burns and smoke inhalation, among others. ABATEMENT CERTIFICATION IS REQUIRED
