5(a)1: of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when exposed to crushing hazards. The employer is failing to protect employees from struck-by and crushing hazards when allowed to work around, and in close proximity to, compacted silage piles. An recent instance of this was documented as occurring when an employee was allowed to stand within very close proximity to the silage pile base when the pile collapsed and fell onto the employee. The employee received critical injuries. Among other methods, feasible and acceptable methods of abatement are: 1) Ensure all employees are instructed on the hazards of storing silage at agriculture establishments. 2) Develop and implement an inspection/evaluation protocol ensuring the silage pile is adequately compacted and the pile walls are square off to help prevent collapse. 3) Develop, implement, and enforce a policy related to work in proximity to silage piles, and specifically addressing the distance needed between employees and the pile when not inside material handling equipment.
