29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    WORKSITE: The employees, removing concrete forms from an excavation measuring approximately 141 feet long, between 10'-10"and 16'-6" wide, and between 5'-0" and 14'-6" deep were not provided with a safe means of egress at least every 25 feet throughout the excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence.     WORKSITE: The employer did not conduct thorough inspection of the excavation for unsafe conditions, such as (but not limited to) safe means of egress and the need for cave-in protection.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    WORKSITE: The Husky, 5-foot fibergalss stepladder, used by employees to egress the excavation did not extend at least 3-feet above the excavation, and no handhold or equivalent was provided.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.    WORKSITE: The Husky 5-foot fiberglass stepladder, used by employees to egress the excavation, was setup in the closed position and employees had to use the top step of the stepladder to egress the excavation.
