OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating a forklift without a serviceable seat belt and training on safe operations:   a) Maintenance shop: On October 25, 2013 and at times prior thereto the latch plate was missing from the seatbelt on the Clark powered industrial truck (forklift), model GC-S17, making it un-serviceable.     b) Maintenance shop: On October 25, 2013 and at times prior thereto the employer did not provide employees with formal training on proper and safe operation of powered industrial trucks (forklifts).  Employees operated a GC15 model Caterpillar and GC S17 model Clark forklift.     Note) Abatement certification IS required for this item.
