29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.        a) On or about 10/21/13, at the south exterior of the Catholic Shop at the Southgate Plaza, 950A Union Rd., West Seneca, NY: Two 16 ft. long 2"x12" scaffold planks were placed one on top of the other. The planks spanned a distance of approx. 12 ft. and rested on the end "kickplate" of a large scissors lift on the west side, and on the top of a narrow mobile scaffold on the east side. An employee standing on the planks doing plastering was exposed to a fall of 7 ft. because there was a gap of approx. 24 inches between the uprights on the mobile scaffold and the planking. Furthermore the uprights on the mobile scaffold were only about 1 1/2 in. high, and would not have prevented the top plank was sliding off the bottom plank.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.        a) On or about 10/21/13, at the south exterior of the Catholic Shop at the Southgate Plaza, 950A Union Rd., West Seneca, NY: Two 16 ft. long 2"x12" scaffold planks were placed one on top of the other. The planks spanned a distance of approx. 12 ft. and rested on the end "kickplate" of a large scissors lift on the west side, and on the top of a narrow mobile scaffold on the east side. An employee walked the narrow plank to the scissors lift and climbed the end frame to enter the scissors lift to get materials that were stored in the lift.       NO ABATEMENT CERTIFICATION REQUIRED
