29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met and as referenced by the note contained in 1926.59: On or about 10/25/2013 at the Mountainside Treatment Center Expansion Project, the employer did not have a hazard communication program nor any material safety data sheets. Employees were using masonry products and were exposed to chemicals such as but not limited to Silica.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person. On or about 10/25/2013 at the Mountainside Treatment Center Expansion Project, Employees were erecting and working from a tubular welded frame scaffold and no competent person was on site nor supervised the erection and use of scaffold. The employees performing the erection and working from the scaffold were not trained by a competent person.
