29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a) Worksite, 55 Hammond Rd., Glen Cove, NY, roof of residence- Employees were using a pneumatic nail gun to install roofing shingles on a residence and were not wearing eye protection; on or about 10/31/13.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    a) Worksite, 15 Hammond Rd., Glen Cove, NY- rear of residence- employees were exposed to falls while using a 30 foot aluminum extension ladder that had a bent rung and a broken foot; on or about 10/31/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    Worksite, 55 Hammond Rd., Glen Cove- Employees were not wearing protective helmets while being exposed to struck-by hazards from the side and overhead when working below employees on roof working with tools and matierals such as roof shingles, felt paper, and nail guns; on or about 10/31/13.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.    Duartes Family Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.100(a), which was contained in OSHA inspection number822901, citation number 1, item number 1 and was affirmed as a final order on 3/5/13 with respect to a workplace located at 80 Shipherd Ave., Lynbrook, NY.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Worksite, 15 Hammond Rd., Glen Cove, roof of residence- Employees  were reroofing a residence at a height of approximately 20 feet on a roof with a 4/12 pitch. The employees were working without fall protection; on or about 10/31/13.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.      Duartes Family Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503 (b)(13), which was contained in OSHA inspection number 822901,  Citation 1, Item 1 and affirmed as a final order on3/5/13 with respect to a workplace located at 80 Shipherd Ave., Lynbrook, NY.
