OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were subject to being struck by falling loads from below-the-hook lifting devices. a) Powder Mixer Area. Employee(s) used a barrel-turning below-the-hook lifting device to pick up and dump 500 lb. barrels of metal powder into the open top of a mixer. The below-the-hook lifting device was not rated and labeled for load capacity and did not have frequent and documented periodic inspections by a qualified person to ensure the device did not have deficiencies such as improper components, deformation, cracks or excessive wear. There is no abatement certification or documentation required for this item.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working in an elevated platform on the forks of a material handling powered industrial truck that did not have adequate guardrail protection. a) Entire Facility. Employee(s) stood on a platform elevated on the forks of a material handling powered industrial truck in order to access equipment and overhead lights at heights of approximately 6-13 feet. The platform was deficient in that it did not have a midrail below the top rail around the three open sides of the platform to protect employees from falls. No other means of fall protection was utilized. There is no abatement documentation or certification required for this item.
