29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On or about 11/12/13, on the upper roof of commercial building, 1700 Niagara St.,Buffalo, NY: Employees engaged in roofing work, working in hoist areas, working in areas near energized electrical wires, using ladders, electrical equipment such as saws, extension cords, air compressors, and air nailers were not trained about Osha fall protection regulations, ladder safety regulations, electrical regulations, personal protective equipment requirements, and applicable OSHA regulations pertaining to other hazards that the employees may potentially be exposed to when engaged in roofing work.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems:    a)  On or about 11/12/13, on the upper roof of commercial building, 1700 Niagara St.,Buffalo, NY: Employees engaged in roofing work on a flat roof, and working in a "Hoist Area" unloading materials from a truck crane were exposed to a potential fall of approx. 21 ft. because no conventional fall protection system such as but not limited to Guardrails or Personnal Fall Arrest/Restraint System was utilized.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:   a) On or about 11/12/13, on the lower roof of commercial building, 1700 Niagara St.,Buffalo, NY: Employees used an Aluminum Extension Ladder placed on the north side of the building to access the lower roof. The siderails of the ladder were approx. 2 ft. away from energized overhead wires leading to the "service drop". Additionally, these wires were only about 5 ft. above the roof surface where employees were walking and carrying materials. The voltage in the wires was at least 220 volts-ac.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  a)  On or about 11/12/13, on the upper roof of commercial building, 1700 Niagara St.,Buffalo, NY: Employees engaged in roofing work on a flat roof were exposed to a potential fall of approx. 21 ft. because no adequate fall protection system was utilized.  b)  On or about 11/12/13, on the lower roof of commercial building, 1700 Niagara St.,Buffalo, NY: Employees engaged in roofing work on the low slope roof were exposed to a potential fall of approx. 11 to 13 ft. because no fall protection system was utilized.   NO ABATEMENT CERTIFICATION REQUIRED
