29 CFR 1926.102(a)(1):     Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    On 11/8/2013, workers from Berry Construction were repairing roofs at several residential buildings located at 2, 4, 6, 58, 60, & 62 High Ridge Court, St. Charles MO.  They were not wearing eye protection while using pneumatic nailers.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     On 11/8/2013, workers from Berry Construction were repairing roofs at several residential buildings located at 2, 4, 6, 58, 60, & 62 High Ridge Court, St. Charles MO.  They were not utilizing guardrail systems, a safety net system, or personal fall arrest systems.  Eight employees were observed on the roofs of the several residences without fall protection, exposing them to fall to the ground below.

29 CFR 1926.1053(b)(1):    When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     On 11/8/2013, workers from Berry Construction were repairing roofs at several residential buildings located at 2, 4, 6, 58, 60, & 62 High Ridge Court, St. Charles MO.  They were using three ladders improperly.  The ladders were not extended to three feet beyond the landing or edge of the roof.
