Condition observed on/or about November 13, 2013.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:       a) 61 West Lincoln Avenue, Milltown, NJ 08850: Employees were observed performing 2nd level siding operations with a height of approximately 11' 8" to the ground below with no fall protection in place, exposing them to fall hazards.      Condition observed on or about November 13, 2013.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a) 61 West Lincoln Avenue, Milltown, NJ 08850:  Employees were observed utilizing a 20 foot Werner ladder to access the roof that contained structural damage including bend/broken rails and a missing string to extend the upper section.       Condition observed on/or about November 13, 2013.
