29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:     a)  In the Facility, on or about November 26, 2013 - The employer did not institute a continuing effective hearing conservation program when employee noise exposures exceeded an 8-hour time-weighted average sound level of 85 dBA.  An employee designated as a Mold Maker was exposed to noise at a level of 66.9% of the allowable limit during a 294 minute sampling period on November 26, 2013.  This exposure is equivalent to a sound level of 87.1 dBA for the dose and time of employee exposure and is 1.3 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.     b)  In the Facility, on or about November 26, 2013 - An employee designated as a Cleaner/Mold Maker was exposed to noise at a level of 67.1% of the allowable limit during a 288 minute sampling period on November 26, 2013.  This exposure is equivalent to a sound level of 87.1 dBA for the dose and time of employee exposure and is 1.33 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.

29 CFR 1910.95(g)(8)(ii)(B): Unless a physician determines that the standard threshold shift is not work-related or aggravated by occupational noise exposure, the employer did not ensure, when a standard threshold shift occurs, that for employees already using hearing protectors, employees be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary:   a)   In the Facility, on or about November 26, 2013 - Employees who have had a standard threshold shift were not refitted and retrained in the use of hearing protection.
