OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about 11/16/2013 - on Highway 78 in Adamsville, AL, the employer did not ensure that employees were adequately protected when trimming trees and removing brush in a highway work zone in that: a) The length of the taper used in the workzone, 150-175 feet, was less than half the required length based on the speed limit and width of the lane. b) The flagger was not standing far enough in advance of the work space to alert and slow the traffic. c) The traffic control devices (cones) were spaced 120 feet apart, more than twice the maxmium distance based on the speed limit of the roadway. d) The employer did not have a Traffic Control Work Plan (TCP) for this job-site.
