29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a)  Barclay Glen at Cross Keys, Williamstown, NJ Building 1400: Employees working on the roof, using portable tools, were not protect by hard hats, observed on or about 11/19/13.    (b)  Barclay Glen at Cross Keys, Williamstown, NJ Building 1600: Employees unloading materials from a crane on the roof were not protect by hard hats, observed on or about 12/14/13.    NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:       (a)  Barclay Glen at Crosskeys, Williamstown, NJ Building 1400: The metal Werner ladder, model# D1540-2, was not extended to 3 feet beyond the access point. The ladder only extended approximately 8 inches. Employees were exposed to a 30 foot fall, observed on or about 11/19/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)  Barclay Glen at Crosskeys, Williamstown, NJ Building 1600: Employees were exposed to 19 foot fall hazards while working on a roof without the use of fall protection, most recently observed on or about 12/4/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
