29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. Warehouse and storage area- On or about November 25, 2013, employer installed an additional hand guard that had been bolted to frame of forklift that had not been authorized or approved by manufacturer for installation. Thereby exposing employees to fall(s) from elevated heights.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. Warehouse storage and distribution center- On or about November 25, 2013, there were two forklift's that had not been kept in a safe working condition. Thereby exposing employees to struck-by hazard(s). 1. Raymond Electric Corporation #5, serial number: EZ D0939846- Faulty Brakes. 2. Toyota Electric Corporation #6, serial number: 7FBCU30- Faulty Brakes. 3. Yale Forklift #4, serial number: A801N06737U- Battery compartment was not secured properly. The compartment was taped shut on front, rear, and both sides, with red masking tape.
