OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by fragments of polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured: a) 1792 Jodie Parker Road, Ozark, AL 36360; On or about November September 18, 2013 and at times prior thereto the employer exposed employees to the hazard of being struck-by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured: a) Shop Areas - PVC plastic piping was used in exposed above ground locations to transport compressed air at 110 psi. The employer failed to follow ASME Gas Transmission and Distribution Piping Systems - ASME Code for Pressure Piping, B31. Section 842.3.3 Installation Provisions which prohibits the above ground use of PVC pipe for compressed air conveyance.
