29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      (a)   On or about 12/02/13, at the Ethan Pointe Apartment Homes, located at 2299 Brighton Henrietta Town Line Road in Rochester, New York, fall protection was not in use by an employee clearing snow from an elevated working platform 21 feet above ground level.            NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      (a)   On or about 12/02/13, at the Ethan Pointe Apartment Homes, located at 2299 Brighton Henrietta Town Line Road in Rochester, New York, a ladder used to gain access to an upper landing 12 feet above ground level was not positioned so that the ladder side rails extended 3 feet above the landing.    NO ABATEMENT CERTIFICATION REQUIRED
