Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by and/or crushed-by machinery and/or equipment which were causing or likely to cause death or serious physical harm to employees:        This violation was discovered on November 13, 2013, at West-Pak, Inc. facility located at 4111 Platinum Way, Dallas, Texas; where employees were exposed to struck-by and/or crushed-by hazards while operating an electric overhead chain hoist with a spreader beam attached. The spreader beam did not have the rated load legibly marked on its main structure or on a tag attached to its main structure where it was visible.
