29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) 1100 Spring Garden Street, Philadelphia, PA - The employees were working approximately 11 feet above the ground on a fabricated framed scaffold, which was approximately 35 feet long, by 3 feet wide and 13 feet high, which did not have a ladder for the employees to access the working level of the scaffold, thus exposing the employees to a fall hazard. The employees would access the working level of the scaffold by climbing the vertical supports and cross bracing. This violation was observed on or about November 21, 2013.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress:  a) 1100 Spring Garden Street, Philadelphia, PA - The employees would access the working level of the fabricated frame scaffold by climbing the cross bracing, thus exposing the employees to a collapse/struck-by hazard. The employees were working on a fabricated framed scaffold, which was approximately 35 feet long, by 3 feet wide and 13 feet high. The employees would utilize the scaffold to conduct the stucco and carpentry process.This violation was observed on or about November 21, 2013.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems:  a) 1100 Spring Garden Street, Philadelphia, PA  The employees were working approximately 11 feet above the ground on a fabricated framed scaffold, which was approximately 35 feet long, by 3 feet wide and 13 feet high, which was not equipped with a guardrail system to protect the employees from falling, thus exposing the employees to a fall hazard greater than 10 feet. This violation was observed on or about November 21, 2013.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(f)(6): Scaffolds wer erected, used, dismantled, altered, or moved such that they or any conductive material handled on them might come closer than 3 ft to exposed and energized power lines:  a)1100 Spring Garden Street, Philadelphia, PA - The employees were working approximately 11 feet above the ground on a fabricated framed scaffold, which was approximately 35 feet long, by 3 feet wide and 13 feet high, which was within approximately 3 feet of the energized (120/208 volts) power service lines, thus exposing the employees to a shock/electrocution hazard.This violation was observed on or about November 21, 2013.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
