29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: The employer does not ensure that a safe means of egress is located in excavations. This violation occurred on or about December 4, 2013, on the south side of the excavation where an employee was exposed to injury when grading the depth of an excavation greater than 4 feet without a means of egress. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a safe means of egress is located in excavations.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. The employer does not ensure that equipment is kept at least 2 feet from the edge of the excavation. This violation occurred on or about December 4, 2013, on the west side of the trench where employees were exposed to struck-by hazards when grading the depth of an excavation without moving the excavator more than 2 feet from the edge. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that equipment is kept at least 2 feet from the edge of the excavation.

The employer does not ensure that each employee in an excavation is protected from cave-ins by an adequate protective system. This violation occurred on or about December 4, 2013, on the southeast side of the excavation where an employee was exposed to crushed-by hazards when grading the depth of an excavation greater than 5 feet in depth without providing a cave-in protection system. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in an excavation is protected from cave-ins by an adequate protective system.
