OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from the hazard of explosions of wood dust from a lack of isolation devices: (a) 5124 Sugar Run Road Millerstown Pennsylvania - The duct was not equipped with isolation devices to prevent deflagration from propagating from the ducts and dust collector back through the inlet ductwork to the woodworking equipment, on or about December 5, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.213(f)(1): Feed rolls and saws were not protected by a hood or guard to prevent the hands of the operator from coming in contact with the in-running rolls at any point. The guard was not constructed of heavy material, preferably metal, and the bottom of the guard did not come down to within three-eighths inch of the plane formed by the bottom or working surfaces of the feed rolls. This distance (three-eighths inch) may be increased to three-fourths inch, provided the lead edge of the hood is extended to be not less than 5 1/2 inches in front of the nip point between the front roll and the work. (a) Back Shop - An employee operates a chop saw to cut wood. The employer did not ensure that the saw had a guard that come down to within three-eighths inch of the plane formed by the bottom or working surfaces of the feed rolls, on or about December 5, 2013. No abatement certification or documentation required.
