OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from the hazards of falls from elevations while working from unapproved forklift platforms: On or about December 3, 2013, and in times prior thereto, a personnel work platform was utilized on a JLG forklift for rigging up at the oil lease. The platform did not accommodate the insertion of the forks on the JLG forklift and was not adequately secured to the forklift. One feasible abatement method, among others, would be to require that only aerial lifts (i.e. manlifts) are to be used to elevate personnel as necessary during rigging up operations.

29 CFR 1910.178(l)(3)(i)(G): Powered industrial truck operators did not receive initial training on fork and attachment adaptation, operation, and use limitations; On or about December 3, 2013, and in times prior thereto, forklift operators were not trained in the use and limitations of a personnel basket used with a JLG rough terrain forklift. The attachment of the basket to the forks was not covered in the employer's forklift training program. The platform was used to lift and transport employees during rig-up operations, exposing oil well drilling rig and supporting services' workers to a fall from elevation hazard of over 20 feet.
