OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee wase exposed to a pinch point hazard: (a) 108 Wells Rd Cheshire, MA: On or about October 28, 2013, an employee loading asphalt into the bucket of a Komatsu PC 40 excavator had 2 fingers amputated as a result of those fingers being pinched between the moving parts of the excavator as its operator was attempting to gain control of the load. Among other methods, feasible and acceptable means to correct this hazard would be to:, 1.Ensure that the excavator operator is not articulating the arm of the excavator while other employees hand placement is obscured or 2. Follow the general Precautions provided in the manual for this excavator which states that when 2 or more workers are carrying out operations, always agree on the operating procedure before starting...always inform your fellow workers before starting any step of the operation. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
