29 CFR 1926.501(c): When employees were exposed to falling objects the employer did not require employees to wear hard hats and did not implement measures to prevent objects from falling from higher levels as set forth in (c)(1)-(3) of this section:    On or about December 6, 2013, in front and to the right corner of the building, an employee was standing directly below equipment being hoisted up by hand as high up as approximately 32-feet. The employee was not wearing a hard hat for protection and was exposed to struck-by hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    On or about December 6, 2013, on top of the roof and to the front right corner of the building, one employee was hoisting up equipment by hand while standing at the edge of the roof. The employee did not have any form of fall protection and was exposed to a fall hazard of greater than six feet.    Four Star Roofing Inc. was previously cited for a violation of this occupational safety and health standard CFR 1926.501(b)(1), which was contained in OSHA inspection number 313495855, citation number 01, item number 001 and was affirmed as a final order on November 17, 2009, with respect to a workplace located at 1393 George Dieter, El Paso, TX 79936.
