29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA.    a)  Jenkins Excavating, Inc. on or about December 3, 2013 at the site located near the 4400 block of Hartland Center Rd. Collins, OH: The employer failed to ensure appropriate traffic control devices conforming to Part VI of the Manual of Uniform Traffic Control Devices  Millennium Edition were utilized during the movement of heavy equipment across active lanes of traffic. While operating in dark conditions, employees performing flagging duties were exposed to struck-by injuries caused from a vehicular collision.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition).    a) Jenkins Excavating, Inc. on or about December 3, 2013 at the site located near the 4400 block of Hartland Center Rd. Collins, OH: The employer failed to ensure flaggers controlling traffic in dark conditions were trained in flagging operations and visible to vehicular traffic by ensuring high visibility garments were worn while working in an active roadway. Due to this condition, employees were exposed to struck-by injuries caused from a vehicular collision.
