29 CFR 1910.134(c)(2): Where respirator use is not required:  29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and  a) At the establishment, where an emploee voluntarily used a 3M- 5201 respirator when spray painting during small paint jobs, the employer had not provided the employee a copy of 1910.134 Apendix D as required.

29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  a) At the establishment, where an employee voluntarily used a 3M- 5201 respirator when spray painting during small paint jobs, the employer had not determined that the employee was medically able to use the respirator and had not trained the employee in the cleaning, storing, or maintaining of the respirator.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a) At the establishment, where employees worked with chemicals such as, but not limited to, Premium Commercial Coating 3.5 VOC Enamel Paint, Ultra Pro-Max Lt Mach Gray Paint, Crossfire Plus Reducer, Crossfire Acrylic Enamel System Paints, and Martin Senour Paints Acrylic Enamel System Paints employees had not received effective information and training to include the health hazards of the chemicals being used and the means the employer had implemented to protect the employees from those hazards.
